Madoff gets 150 years in prison

Wall Street swindler Bernard Madoff has been sentenced to 150 years in prison for his role in the largest ponzi scheme to ever hit the U.S. Madoff pleaded guilty in March to 11 federal crimes including securities fraud, wire fraud, mail fraud, money laundering, perjury and making false filings with the SEC. Madoff defrauded clients of $65billion and refused a plea deal instead pleading guilty to all charges.

Lazio will run for New York Governor

Former Long Island Congressman Rick Lazio will seek the Republican nomination for Governor an aide has confirmed to the AP. "He fully intends to", said the source. Lazio could face Rudy Giuliani in the Republican primary for Governor.

Lazio was the Republican nominee for the U.S. Senate in 2000 losing to Hillary Clinton. Lazio was a foot solider in the Gingrich revolution while serving in the House.

A Lazio-Giuliani primary for Governor would be very interesting to watch.

King of Pop MICHAEL JACKSON DIES


The L.A. Times confirming right now that Michael Jackson the King of Pop, an icon in the pop world was rushed to UCLA Medical Center after going into cardiac arrest and is dead at the age of 50.

Those of who us who follow music will never forget the Jackson 5. Michael was a star, a humanitarian who cared deeply about people and a brilliant performer and entertainer. I remember "Thriller", "Billie Jean" and of course "Beat It", "Black or White".

Jackson was a dedicated humanitarian and author of "We are the World". Michael Jackson is in the Rock N Roll Hall of Fame and was the King of Pop.

Farewell Michael and thank you for great music. It was fun watching you!

Haley Barbour takes over RGA could be rising star

Amid the Sanford sex scandal, South Carolina Governor Mark Sanford stepped down as Chairman of the Republican Governor's Association handing the Chairmanship over to Mississippi Governor Haley Barbour. Sanford was viewed as a formidable and leading Republican candidate for the Presidency in 2012 but now it could be Barbour who is the leading candidate.

With Sanford out and Huckabee losing ground every time he opens his mouth, Barbour could be the solid southern conservative running for the Presidency. As Chairman of the RGA he is the most powerful Republican in the country and as a former RNC Chairman he has access to the fund raisers.

As a Democrat I would savor and hope for a race against the former Washington lobbyist. He is an owner of Barbour, Griffiths and Rogers which is a lobbying firm. Barbour receives a pension and profit sharing benefits from the the company. The firm has lobbied the state to give Hurricane Katrina recovery contracts to it's clients. Barbour has refused to sign a cigarette tax increased passed by the state House and Mississippi has the third lowest cigarette tax but highest grocery tax all the while being the poorest state in the country.

I say Go Barbour Go! The Obama team is ready!

Well here's some more news from the party of family values. South Carolina Republican Governor Mark Sanford a top prospect for the Republican nomination for President in 2012 admits to an affair.

The admission comes about a week after Sen. John Ensign another Republican wrapped in the flag of family values admits to cheating on his wife.

These admissions come nearly two years after pro family values Sen. David Vitter admitted to be involved with a prostitute. Vitter by the way succeeded Republican Bob Livingston in Congress. Livingston left after well, you guessed it, he admitted to an affair.

In between this about two years ago Republican Larry Craig ends up in jail for lewd conduct in a men's room.

Anyone remember Newt Gingrich. Well he might run for President in 2012. He was having an affair while he led the Lewinsky investigation.


The interesting thing here is. In 1999 David Vitter said Clinton should resign for the sex scandal. John Ensign called on Clinton to resign when he was running for the Senate. Newt led the investigation against Clinton when he was Speaker. Sanford was in Congress and voted to impeach Clinton. Larry Craig went after Clinton.


So here's my question. When do Mark Sanford, Larry Craig, John Ensign and David Vitter resign??? I think President Clinton should call on all of these hypocritical bastards to resign. When will Sean Hannity call on them to resign? What about Rush? I am waiting for Limbaugh to demand Sanfords resignation?

The right wing should be enraged right now. Wheres the rage?????

Former Edwards aide looking for a book deal

According to reports Andrew Young, a longtime aide to John Edwards and friend of the Edwards family is looking for a tell all book deal regarding Edwards.

The proposal which will tell "the tale of his friendship with the Edwards family, his attempt to help Edwards by taking a pregnant Rielle Hunter into his home to live with him and his wife Cherri, and their three children and the fallout when the press caught wind of the plan", reported by Daily Beast.

The proposal also includes photos of Edwards with the alleged love child.

With George Voinovich retiring in Ohio, Republicans are in a battle to hold onto his U.S. Senate seat. Sherrod Brown won the Senate seat in Ohio in '06, Strickland won the Governor's office, Obama carried Ohio in '08 and Democrats are poised to win the Senate seat in '10.

According to a new poll Democratic Lt. Governor Lee Fisher leads Republican Rob Portman, 41% to 32%. Democratic Secretary of State Jennifer Brunner leads Portman 40%to 32%.

The poll shows that either Brunner or Fisher would win this Senate seat.

I think its great that Dodd is in favor of gay marriage. I believe everyone should have the right to marry and be happy and live in peace. That said I think he's endorsing same sex marriage because he faces a tough Democratic primary and is trying to connect with the base. Interestingly he didn't support gay marriage when he was a Presidential candidate. The fact is Dodd still has countrywide hanging over his head and must be held accountable. That said I support Merrick Alpert in the Dem primary.

Lowering insurance costs for doctors requires Insurance Industry Refrom from Center for Justice and Democracy

As the President's health care reform plan is debated in Washington and doctor's continue to growl about malpractice lawsuits driving up the costs of health care here are some facts from the Center for Justice and Democracy:

In 1944 the insurance industry strong armed Congress into enacting the McCarran-Ferguson Act, which allows insurance companies to fix prices, an anti-competitive practice that for other industries can result in jail time. The act was passed in 1945 after the Supreme Court ruled in U.S. vs South Eastern Underwriters.

Secondly federal law prohibits federal regulation of insurance or Federal Trade Commission scrutiny over the insurance industry.

Many state insurance departments do not have the authority or funding to exercise proper control over insurance industry pricing.

The job of regulating insurance companies is up to the states as the federal government does not have the authority to interfere.

In 1988 the voters of California passed Prop 103 which was an insurance regulatory law. The proposition "reduced California doctors premiums by 20% within three years" and led to stable rates.

Between 1988-2000, malpractice premiums dropped 8% in California while on a national scale they were up 25%. California's 9th largest medical malpractice insurer proposed a 29.2% rate hike. This led to public hearings on rate hikes and rate hikes in California were lowered three times.

According to the CJD heres what Congress can do:

Remove the antitrust exemption that insurance companies enjoy under McCarren-Ferguson which allows the insurance industry to fix prices. This would prohibit monopolization, market allocation, and tying arrangements. Competition will bring lower prices and bring the availability of insurance.

Lift Congressional restrictions that prevent the FTC from investigating fraudulent acts in the insurance industry.

Encourage uniformity in state insurance regulation as long as consumer protection standards are met.

End the practice of charging rates based on speciality, not a doctor's malpractice experience. This is unfair not only to the good doctors but also to doctors who are at higher risk OB GYNS, neurosurgeons who are paying a higher rate then a dermatologist.

Rumors are that billionaire businessman Tom Golisano who has run for Governor of New York three times as an Independent is considering a run for the U.S. Senate in Florida as a Democratic candidate. Golisano owns homes in New York and Florida however he recently switched his legal residence to Florida. Golisano was approached by Governor Crist for financial support but turned the Governor down.

Golisano never made it as governor of NY and will not make it to the Senate from Florida. Kendrick Meek will be the Democratic nominee for US Senate in Florida and the states next Senator.

America favors Obama health care plan

A new poll from ABC News shows that 72% of Americans support the Public Health Care Plan being offered by the Obama administration and 57% will pay higher taxes to finance the plan according to ABC News.

Despite public support for the plan, war is unraveling on Capitol Hill over the plan and Democrat's fear that the plan is in trouble. Senior Democratic advisers are telling the White House that President must get involved in the push for his health care plan. Despite this the President is hopeful that they will have a health care plan in 2009. Democrats in the Senate are nervous that they will not have the 60 votes to pass the plan and Senate Majority Leader Reid is pointing out that he can use arcane budget rules known as reconciliation that would only require 51 votes to pass the plan.

The parties disagree on how to bring about health care reform. The Democratic Party wants a public option that would compete with private insurance companies while the GOP says such a move would lead to a government takeover of health care.

A bipartisan group consisting of former Senate Majority Leader's Tom Daschle, Howard Baker and Bob Dole have offered an outline for an alternative plan to overcome party divisions and rancor.

The public health care plan is the way to go. Every American must have access to health insurance regardless of pre existing condition. I think it will pass but I am nervous about it. Daschle would have been better as HHS Secretary and could probably have an easier time at getting this passed given his connections on THE HILL. I have confidence in Sebelius but I am nervous.

Paterson remains unpopular in New York

New York Governor David Paterson continues to remain unpopular as we approach the 2010 midterm elections. The latest poll from Siena Research shows Paterson's approval rating at 31%. In a potential Democratic primary, Attorney General Andrew Cuomo defeats Paterson, 69% to 16%. In a general election match up Paterson loses to Republican Rudy Giuliani 57% to 27% while Andrew Cuomo would beat Giuliani 49% to 40%

More than any time in my life I understand why people take matters into their own hands. I am disheartened! I have sought wise counsel, tried to do the right thing and continue to run into road blocks (sic) in dealing with a very terrible circumstance and injustice that lives in my life. I am hoping you and Fox News can help.

My name is Doug Hampton. I am a former employee of US (sic) Senator John Ensign. I worked for Senator Ensign in his official government office on Capitol Hill from November 2006 to April 2008. My responsibilities were the oversight of his personnel in Washington as well as the state of Nevada. Duties included budgets, policy and public speaking on behalf of the Senator and his initiatives.

Here is my story. In December of 2007 in the midst of some very difficult personal issues that deeply impacted my family and marriage, Senator Ensign pursued and engaged in a relationship with my wife. Our families were lifelong friends, our children attend school together to this day, and our homes are in neighborhoods across from each other. My wife was the Senator’s campaign treasurer.

There is a tremendous amount (sic) of details and critical facts associated with this story and their relationship that will not be addressed in this letter but are very important and need to be further explored if you choose to meet with me. The purpose of this letter is to establish the framework for discussion and provide enough information to warrant a meeting with you and Fox News. This is the only letter of its kind and no other news stations have been contacted with this information. I have great respect and affection for Fox News and many of your collages (sic). I’m sending this to you because you have a legal back ground (sic) and this story has several legal elements.

The unethical behavior and immoral choice of Senator Ensign has been confronted by me and others on a number of occasions over this past year. In fact one of the confrontations took place in February 2008 at his home in Washington DC (sic) with a group of his peers. One of the attendee’s (sic) was Senator Tom Coburn from Oklahoma as well as several other men who are close to the Senator. Senator Ensign’s conduct and relentless pursuit of my wife led to our dismissal in April of 2008. I would like to say he stopped his heinous conduct and pursuit upon our leaving, but that was not the case and his actions did not subside until August of 2008.

The actions of Senator Ensign have ruined our lives and careers and left my family in shambles. We have lost significant income, suffered indescribable pain and emotional suffering. We find ourselves today with an overwhelming loss of relationships, career opportunities and hope for recovery. Our pursuit of justice continues to place me and my family in harm’s way as we fear for our well being (sic).

Today, Senator Ensign’s responsibility and stature have increased within the US (sic) Senate. His is currently the head of “Policy” for the Republican Party, the number four position within the Parties (sic) leadership team. We on the other hand are completely ruined and left to deal with the aftermath of very evil and completely unjustifiable acts by one of our countries (sic) top leaders.

It appears there may be nothing the law can do to correct and bring justice and restitution to (sic) this terrible wrong that has been done to us. I have sought a number of lawyers who are having difficulty finding charges that may hold up in court. There are either technicalities that exist due to the time period in which I have sought help, or other nuances that quite frankly make no sense to me given the egregious acts and blatant abuse of power by Senator Ensign. From my perspective this whole nightmare is terribly wrong and completely unacceptable and should not be tolerated.

I clearly understand this story is difficult to believe for anyone reading (sic) for the first time. I too would have difficulty believing it, if someone brought me this story. However I assure you it is true and there are facts, a paper trail, phone records and personal witnesses to testify to its truth. It is my belief we are dealing with a very powerful person and an institution in the US (sic) Senate that only the media can pierce to expose the wrong and bring light and focus to what needs to be done? (sic)

Please help me! This should not be how the leadership of our country should be allowed to behave. I need justice, help and restitution for what Senator Ensign has done to me and my family. Regardless of technicalities, regardless of position, regardless of power this cannot and should not be tolerated in our country from our trusted leaders. Will you help? Will you consider a meeting with me to further discuss this story and what can be done to bring justice and correction to this situation?

I love this country and considered it a great privilege to work in the US (sic) Senate. I am bringing this to you and Fox News to address this professionally and correctly. I could have sought the most liberal, Republican hating media to expose this story, but there are people’s lives at stake and justice is about proper process as well as outcome. Senator Ensign has no business serving in the US (sic) Senate anymore! I will send you and (sic) email as well as leave you and your staff messages in an attempt to meet you and your team as soon as possible. I live and work in Nevada but can be in New York within hours, I look forward to your help.

This week, the Congressional Budget Office released a partial analysis of the Senate health committee's draft health care reform bill. And immediately, Glenn Beck, Sean Hannity, David Brooks, USA Today, The New York Times, and ABC's Jake Tapper all misinterpreted its findings, claiming that the legislation would cost a trillion dollars while still leaving nearly 40 million Americans uninsured. In The United States Under the First Amendment, newspapers and magazines can say what they like about minority groups and religions - even false, provocative or hateful things - without legal consequence.

In most developed countries of the rest of the world, hate speech is a crime.

In Switzerland, the Limbaugh, O'Relly or Glen Beck and other right extremist nuts would be sent to jail as public discrimination or invoking to rancor against persons or a group of people because of their race, ethnicity, is getting penalized with a term of imprisonment until 3 years.

France prohibits the publication of material which is defamatory or insulting, or which incites discrimination, hatred, or violence against a person or a group of persons on account of place of origin, ethnicity or lack thereof, nationality, race, or specific religion. The law prohibits incitement to discrimination, hatred, or violence against persons on the basis of their sex, sexual orientation, or handicap. The law prohibits declarations that justify or deny crimes against humanity, for example, the Holocaust and the Armenian Massacres by the Ottoman Turks during WWI.

French law allows a plaintiff to launch an action on account of hate speech in a criminal court or in a civil court. The Public Prosecutor can turn a civil action into a criminal action. The penalties include imprisonment, a fine, or both.

In Germany Volksverhetzung ("Sedition") is a punishable offense under Section 130 of the Strafgesetzbuch (Germany's criminal code) and can lead to up to five years imprisonment. Section 130 makes it a crime to publicly incite hatred against parts of the population or to call for violent or arbitrary measures against them or to insult, maliciously slur or defame them in a manner violating their (constitutionally protected) human dignity.

In the US, even in cases where speech encourages illegal violence, instances of incitement qualify as criminal only if the threat of violence is imminent. This strict standard prevents prosecution of many cases of incitement, including prosecution of those advocating violent opposition to the government, and those exhorting violence against racial, ethnic, or gender minorities. See, e.g., Yates v. United States (1957), Brandenburg v. Ohio (1969).

Ensign’s mistress saw salary double, son was paid $5,400

The one-time mistress and campaign treasurer of Sen. John Ensign saw her salary double during the time of the affair, according to federal election documents.

Cynthia Hampton, whose husband, Doug Hampton, was a senior aide to Ensign, the Nevada Republican, was paid nearly $1,400 per month for most of 2007 as treasurer of Ensign's Battle Born Political Action Committee.

Her salary increased slightly in January 2008 but then doubled to nearly $2,800 per month in February 2008 and stayed at that higher rate through March and April, when she left the job. More.

Iran’s hard-liners are already working hard to pin the election dispute, and the protests, as the result of American meddling. On Wednesday, the Iranian Foreign Ministry chastised American officials for “interventionist” statements. Government complaints of slanted coverage by the foreign press are rising in pitch.
We can’t escape the reality that for reformers in Tehran to have any hope for success, Iran’s election must be about Iran — not America. And if the street protests of the last days have taught us anything, it is that this is an Iranian moment, not an American one."

John Edwards remerges

Former Senator John Edwards who I think would have made a great President recently granted the Washington Post a 90 minute interview. Relax, he didn't talk about you know what or you know who, so this isn't going to be a juicy blog entry.

He did talk about his volunteer work in Central America. He is spending time in El Salvador and will return next month. He says he has two reasons to be on the planet right now: to take care of "the people I love" and to "take care of the people who cannot take care of themselves".

Edwards said he spends most of his time in his mansion with his wife and young children. He stands behind his Presidential campaign "It was real, 100 percent real". Edwards does not rule out a return to politics but an advocacy role is more likely then an elected position.



John Edwards has a great deal to offer this country and I hope he comes back. I think he was a great Senator and would of made a great President. I know for sure that he would not be giving into the insurance companies on this health care bill. Oh well. Had Kerry followed his advice in 2004 and put up a fight in Ohio and won, Edwards would probably be Vice-President gearing up for a 2012 run. In any doubt I hope he doesn't disappear. He has too much to offer. How about a 2010 Senate run against Burr?

Gillibrand picks up 52 Dem County Chairs

New York Senator Kristen Gillibrand heads into the 2010 Democratic Senate primary with 52 of the states 62 Democratic County Chairs. Those Chairs absent were those closest to New York City, the home turf of likely Gillibrand rival Carolyn Maloney.

Kudos to the New York City Chairs and to the other 52 you have no backbone. My problem with Gillibrand is that she was a Blue Dog Democrat in the House. Gillibrand supports extending the Bush 2001 and 2003 tax cuts which have contributed to the economic crisis our country faces. Gillibrand doesn't understand that you can't fight a war and give the top 1% tax cuts and expect the economy to stimulate. She is not a true progressive. Tasini is the only progressive in the race. He's a long shot but so was Paul Wellstone.

Monserrate back with the Democratic caucus

Just days after Democratic New York state Senator Hiram Monserrate joined Senator Pedro Espada in a coup with Republicans to take over the NY Senate, Monserrate is back with the Democrats.

This move leaves the New York Senate split 31-31, with no Lt. Governor to split the tie. 31 Democrats, 30 Republicans plus Pedro Espada. Republicans made Espada Senate President which also means he is acting Lt. Governor. Republicans are claiming that since Espada is a Senator and Lt. Governor he can cast two votes. Democrats say he can only cast one vote. A Lt. Governor will not be elected until after the 2010 election.

House Republicans unveil health care plan

"House Republicans presented a four-page outline of their health care reform plan Wednesday but they said they didn't know yet how much it would cost, how they would pay for it and how many of the nearly 50 million Americans without insurance would be covered by it".



The Republicans have a plan now I can sleep tonight. Come on, let's be serious. Republicans don't care about health care and health care reform. Any plan put forward by the Republicans in Congress will be written by the insurance companies. Two thirds of Americans want health care reform, that is the reason and the only reason that Republicans are coming forward with a plan. Let's face it this is the party that opposed Medicare. If they had McCain in the White House, they would be fighting for more tax cuts and more privatization of social services. The plan like the party is a joke.

Maloney goes after Gillibrand in New York

Congresswoman Carolyn Maloney is coming out swinging at Senator Kristen Gillibrand as she considers a bid against Gillibrand for the Democratic nomination for the New York Senate seat.

Maloney told the NY Daily News: "Some people run to get elected. She's, to my knowledge, never passed anything. She spends all her time fund raising. I spend my time doing things".

The upper East side Congresswoman is seriously considering a run for the Senate and has formed a statewide finance team.

New York lawmaker claims he gets two votes

This would be funny if Pedro Espada wasn't serious. Senator Espada who joined with Republicans last week in a coup that handed control of the NY Senate to the GOP now claims that he gets two votes in the Senate. Espada is the President Pro Tempore of the Senate and the acting Lt. Governor of New York. He claims that he can vote as a member of the Senate and break ties as the acting Lt. Governor. According to the NY Post, "Legal experts say there are no known examples where a member of the 62-seat Senate was allowed to cast two separate votes".

Espada is an idiot. I can't wait to see him indicted by the Bronx DA. I also blame Gov. Paterson. The Governor should have appointed a Lt. Governor upon taking office.

Ensign resigns Senate GOP leadership post amid affair

Nevada Senator John Ensign has resigned as Chairman of the Republican Policy Committee one day after admitting to an affair with a former staffer. Ensign who is married with children admitted yesterday that he had an affair with Cynthia Hampton who worked on Ensigns political campaigns. Hampton's husband was an administrative assistant in Ensigns Senate office and Hampton's son was employed by the National Republican Senate Campaign Committee when Ensign was Chairman. This is the third Republican Senate sex scandal. David Vitter and Larry Craig are the others. Ensign is gearing up for a Presidential run in 2012. The Republican primary which could include Newt Gingrich, Rudy Giuliani and Ensign could be a discussion over who's mistress was prettier.

As of now I have to say that Gingrich has the best taste but then again, I prefer blonde's.

I really don't care that Ensign cheated on his wife and I would probably not even write about it but I am writing about it. I am writing about it because Ensign was a Senate candidate in 1998 and he called on President Clinton to resign the Presidency because of his affair with Monica Lewinsky. These hypocritical bastards who portray themselves as solid family values candidates go after Clinton and Spitzer, say how disappointed they are in John Edwards and then do the same thing themselves. The GOP is turning into a sad joke.

Kent Conrad is wrong on health care reform approach

North Dakota Senator Kent Conrad has some ideas on health care reform and I could not disagree with him more. Conrad is proposing a plan to create non profit health insurance cooperatives as competitors to private insurers. The Conrad co-op plan is similar to the Bush plan which was described as "association health plans" which would have allowed small businesses, trade associations, and civic, community and religious groups to ban together and purchase insurance.

The Conrad plan which is being embraced by Republicans is a move in the wrong direction and a huge mistake. These plans have been difficult to establish and expand. They are under constant siege from doctors and insurance companies. They operate as huge private insurance plans. The public option is the way to go.

Two influential Dem members of Congress endorse Meek for Senate

Congressman Ron Klein of Boca Raton and Congresswoman Debbie Wasserman Schultz of Pembroke Pines have endorsed Congressman Kendrick Meek for the Democratic nomination for the U.S. Senate. Klein and Wasserman Schultz were both touted early on as possible Democratic contenders for the Senate but say that they believe that Kendrick Meek should get the nomination.

Meek has picked up endorsements from U.S. Congressman Alcee Hastings, Broward County Mayor Stacy Ritter, West Palm Beach Mayor Lois Frankel, Miami Mayor Manny Diaz a leader in the US Conference of Mayors, Gainsville Mayor Pegeen Hanrahan, Tallahassee Mayor John Marks, SEIU, United Dade Teachers of Dade and several other unions through the state.

A recent poll shows Meek leading possible Democratic rival Corrine Brown. Meek's most formidable supporter is former President Clinton.

Obamas smart political strategy

Barack Obama has to be the smart politico in the country. Here are some examples:

A poll touts Republican Utah Governor Jon Huntsman, a moderate Republican as a strong candidate to take on the President in 2012, the strongest Republican to oppose Obama so Obama appoints him Ambassador to China.

He makes an overture to Judd Gregg offering him the Commerce Secretary position knowing that a Democratic Governor would appoint a Democrat to Gregg's Senate seat unfortunately it didn't materialize.

He knows Republicans are savoring for a fight over his Supreme Court nominee so he nominates a Hispanic woman, a key voting bloc for Republicans.

The New York Daily News now reports that the President offered Congressman Peter King of New York the Ambassadorship to Ireland. King turned down the President's offer and is staying in Congress, possibly revving up for a Senate bid in NY.

This is part of Obama's plan to sabotage the GOP and lure moderate Republicans to his side. One word describes it: Brilliant. Simply Brilliant!

No Compromise On Health Care

MEDICAL MALPRACTICE SURVIVORS DECRY POSSIBLE STRIPPING OF RIGHTS IN PRESIDENT’S HEALTH CARE PLAN

NEW YORK – Sixty-four survivors of medical malpractice from 21 states sent a letter to President Obama today expressing extreme concern that the rights of medical malpractice victims have become a “political bargaining chip” in the President’s efforts to sell his health care plan, and that their rights may be stripped away as a result. Reports now indicate that the President supports measures that would drastically limit injured patients’ rights to trial by jury by allowing biased medical societies or politicians to make liability decisions. The group of malpractice survivors have requested a meeting with President Obama to express dissatisfaction with the President’s willingness to include far-reaching medical malpractice limits in his national health care proposal.

The survivors are working with the national consumer group Center for Justice & Democracy in trying to get their voices heard. CJ&D Executive Director Joanne Doroshow said, “Taxpayers have already been asked for billions of dollars to rescue Wall Street banks. Now they may be asked to give up their constitutional rights. What’s next?”

Donna Harnett, a Chicago resident whose son, Martin, was severely brain-damaged at birth due to delivery errors, said, “Any proposal that would limit the right to trial by jury would be devastating to families like mine who have suffered catastrophic injuries. Moreover, it will do nothing to expand health coverage or reduce health care costs.”

“I am very disappointed that the President is considering measures that would put patients' rights in jeopardy. I certainly hope that he accepts our request to meet with families like ours, who have had lives ruined and lost loved ones to medical negligence,” said Michael Bennett of Baltimore, Maryland. Mr. Bennett’s father, Mark Bennett, died after being exposed to six types of bacteria while in the care of a Baltimore-area hospital.

“As survivors of medical negligence, we believe that our voices should be heard in any discussion that could result in curbing the legal rights of seriously injured patients,” said Dylan Malone of Seattle, Washington, whose son, Ian, died several years after being severely brain damaged due to delivery-related errors.

The text of the letter follows:

We are writing to request a meeting with you to discuss the issue of medical malpractice, which news reports now indicate may be part of your national health care proposal as a political “bargaining chip.”

We are part of a group of survivors of medical negligence who are concerned that our voices be heard in any discussion that could result in curbing the legal rights of seriously injured patients. We are extremely concerned that the rights of medical malpractice patients may be stripped away as part of your national health care proposal. This includes restrictions on the rights of catastrophically injured patients to have access to the courts.

People like us and our families certainly do not feel as though doctors and hospitals practice too much “defensive medicine,” or that lawsuits against negligent providers are frivolous, or that there is any justification for eliminating the right to jury trial in medical malpractice cases. Patients deserve to have an unbiased judge and jury, which have heard all the facts and weighed all the evidence, decide if care is negligent and what the compensation for their loss should be. That decision should not be made by political officials or biased medical societies.

Further, tackling medical malpractice issues will not bring down health care costs according to every government study that has looked into this. The Congressional Budget Office has confirmed, “malpractice costs account for less than 2 percent of [health care] spending.” Blaming so-called “defensive medicine” for growing health care costs is also bogus. Listen to our stories and you will understand why no credible government study supports the notion that “defensive medicine” is a problem. Most recently, the General Accountability Office harshly criticized evidence continuously cited by the American Medical Association that the tort system encourages defensive medicine.

Nobody appreciates the need to have competent doctors available to serve in every area of this country more than people like us who have been patients. But making it more difficult for us to bring legitimate cases against negligent providers will make matters worse and certainly not solve this country's real medical malpractice crisis, which now costs the lives of more than 98,000 people each year. It will only reduce accountability in the system and re-victimize people who are already victims.

Obama address American Medical Association

President Obama addressed the AMA in Chicago today and told the group of doctor's that he is opposed to their top legislative priority--limiting malpractice awards---and earned boos from an audience he was in town to court according to the AP.

Calling his critics "naysayers", "fear mongers", the President sent a stern message warning interest groups, lobbyists, and any one else against using "fear tactics to paint any effort to achieve reform as an attempt to socialize medicine." "There are those who will try and scuttle this opportunity no matter what", the President said.

The President said that his plan to cover almost 50 million Americans who do not have insurance would cost about $1 trillion over ten years. The President said, "that's real money even in Washington". "But remember: That's less than we are projected to have spent on the war in Iraq. And also remember: Failing to reform our health care system in a way that genuinely reduces cost growth will cost us trillions of dollars more in lost economic growth and lower wages".

Though the President has stated that he is NOT in favor of capping malpractice awards he has raised concerns among trial lawyers when he began to sympathize with doctors "who feel like they are constantly looking over their shoulder for fear of lawsuits". The Center for Justice and Democracy has released a letter to the President signed by 64 survivors of medical malpractice stating that they were "extremely concerned that the rights of medical malpractice patients may be stripped away as part of your national health care proposal."

Obama co-sponsored legislation in 2005 with then Senator Hillary Clinton of New York that would have created a program to allow patients to learn of medical errors and establish negotiated compensation with the offer of an apology.

Jindal supporters set up federal PAC for 2012;Pawlenty explores run

Supporters of Louisiana Governor Bobby Jindal including the Governor's wife's uncle have set up a federal political action committee to support a Jindal for President run in 2012. Jindal was on the short list for VP in 2008 with McCain and top aides are preparing him for a Presidential run.

Meanwhile Minnesota Governor Tim Pawlenty who has declined to seek a third term in 2010 will travel the country building support for a 2012 White House run. Pawlenty plans to challenge President Obama as a populist and is said to have his eye on the White House in 2012, not the VP nomination and not a 2016 run. Pawlenty also made the short list for McCain.

Jindal is formidable. Pawlenty reminds me of George Pataki. Pataki tried to gain support for a 2008 run, he never attracted support and never ran. I wouldn't be surprised if Pawlenty sits it out. I can't see Pawlenty being able to compete with Romney, Gingrich, Jindal, Huckabee or even Palin.

Biden for President 2016

Vice-President Joe Biden appearing on "Meet the Press" indicated that he still has his eye on the Oval Office. The Vice-President who was involved in the selection of Sonia Sotomayor and has served as a counsel to the President isn't ruling out a 2016 Presidential campaign.

2016 is a long way off but for political junkies like me its always fun to speculate.
Virginia Senator Mark Warner is most likely gearing up for a 2016 run. Montana Senator Jon Tester might jump in. Indiana Senator Evan Bayh might jump in. North Carolina Senator Kay Hagan might get in. Possibly U.S. Secretary of State Hillary Clinton.

A lot can happen between now and then but right now I like Biden/Tester.

2009 Governor's races

In New Jersey incumbent Democratic Governor Jon Corzine is in a tough fight against Republican US Attorney Chris Christie. Christie leads Corzine 50% to 40% while Corzine maintains a 36% approval rating. Corzine also faces other problems. His top choice for Lt. Governor, Newark Mayor Corey Booker doesn't want the job. State Senator Barbara Buono and Trenton Mayor Doug Palmer are top prospects.

In Virginia things look a bit better for Democrats. Democratic Senator Creigh Deeds is leading Republican Bob McDonnell 47%-41%. Deeds easily won the Democratic nomination for Governor and will hopefully continue the trend of Democratic administrations in Virginia. This typically reliable GOP state has elected Democratic Governor's since 2001 and now has two Democrat's in the Senate. Virginia also went with Obama in the 2008 Presidential race.

All eyes on NY State Senator Tom Duane

Last week New York Democratic state Senator's Pedro Espada and Hiram Monserrate cut a secret deal with Republicans and by a 32-30 vote, the Senate was in Republican control and Dean Skelos was sworn in as Majority Leader while Espada was made Senate President Pro Tempore.

Malcolm Smith who served as Senate President Pro Tempore and Majority Leader, the first Democrat to lead the Senate in forty years was ousted in this deal. Here's the trouble Smith had in the Democratic caucus. A majority of Democratic Senator's including Espada and Monserrate support legalizing gay marriage in New York. The House has passed the gay marriage bill and it's waiting in the Senate. Gov. Paterson is ready to sign it. Three conservative Hispanic Democratic Senator's oppose the gay marriage bill and have said they will join the GOP if the gay marriage bill goes to the floor for a vote. Smith knew those three votes would have handed control back to Republicans so the gay marriage bill stalled and gay rights supporters did not receive a commitment on a vote from Smith.

Here's why this Senate deal isn't a done deal. Monserrate was indicted on felony assault charges in March and if he is convicted this summer as expected he will be removed from the Senate. Gov. Paterson will have to call a special election to fill his Senate seat, a Democrat will win, and the Senate will be 31-31. The Lt. Governor usually breaks ties in the Senate but New York doesn't have a Lt. Governor. Eliot Spitzer resigned, Lt. Governor Paterson became Governor and now it's a vacant office.

Heres where Tom Duane comes into the picture. Duane is an openly gay New York State Senator and leading gay rights activist in New York City. Espada and the Republicans are doing some horse trading with Duane. If Duane will break with the Democrat's and cast an organizational vote in favor of the Espada/Skelos leadership team, they will guarantee him a gay marriage vote on the floor when Duane believes he has the five Republican votes to pass the bill. There are 2-3 GOP Senator's who will support the bill. Former Senate President Joe Bruno who opposed gay rights is now in Albany urging support for the bill.

Here's the thing, if Duane joins a bi partisan coalition to get the gay rights bill passed he gives the Republicans a lot of legislative power. If he stands with the Democratic Party, Malcolm Smith is Majority Leader, but a floor vote on gay marriage is blocked.

I commend Duane for fighting for marriage equality. I support marriage equality and believe everyone should have the right to marry regardless of sexual orientation. However I urge Duane to vote with Democrat's and reinstate Smith as Sen. Maj. Leader when Monserrate is removed from the Senate.

Here's my reasoning. Unless Paterson declines to run in 2010 which is highly unlikely, the Republicans are in a strong position to win. Even if Cuomo is the nominee, the African American base will be enraged that he beat the first African American Governor of New York and will sit the election out possibly costing Cuomo the general. If Paterson is the nominee, we'll 19% of Democrat's back him, he's in a tough position which means New York could end up with Governor Lazio or even worse Governor Giuliani. If the Senate makeup doesn't change after the 2010 midterm and a Republican is elected Governor we could have grid lock.

New York like other states is facing a budget crisis, Paterson I believe is doing the right thing by calling for a tax increase on multi millionaire New Yorker's to pay for social services. A Republican Senate is not going to go with a Democratic Governor on a tax increase. A Republican Governor is going to propose tax cuts and major cuts in social services and will have a Republican Senate to support that agenda. With a Republican Senate, we go back to the Pataki era.

Marriage Equality is an important issue but it's not the only issue. Health care is an important issue, affordable housing, education, funding for social services, consumer protection. Duane must look at these issues before making his decision.

NY State Senate President Pro Tempore Espada could face criminal charges

New York Senate President Pro Tempore Pedro Espada who joined a coup last week in giving control of the New York Senate to Republicans could be facing criminal charges. The allegations are that Espada failed to file campaign finance forms. Espada owes the state $3,213 in fines for his 2008 race and going back to 2000 Espada's campaign treasures failed to file 41 reports according to the Daily News. Put this together and they owe $13,553 in fines and penalties.

Espada is also facing an inquiry from Bronx DA Robert Johnson. Johnson is looking into whether Espada lives in his Senate district. Espada owns a co-op in the Bronx but also maintains a second home in Mamaroneck. Prosecutors are also working with Attorney General Andrew Cuomo to determine whether the Soundview Health Center, a non profit controlled by Espada misused funds to aid his political campaign.

Thompson calls for less mayoral control of Water Board

Democratic Mayoral candidate Bill Thompson wants less mayoral control of the city water board allowing the Mayor to only appoint four of the seven members. Water rates in the City of New York have increased 58%, the most recent a 13% increase which brings the average water bill in a New York City household to $903, from the $571 it was four years ago, that's five times the rate of inflation. Two board members were removed last year after questioning a rate hike.

I have recanted my support for Bloomberg and am now pulling for Thompson. Bloomberg's policies favor the wealthy and do nothing to help the average New Yorker. Bloomberg shrugged off unions during the transit strike and has given huge tax cuts to Wall Street while shutting down child care centers through the city. It's time for change and I am encouraging family and friends to go with Thompson.

A little more audacity please

My co blogger and very good friend pointed out last week that President Obama is looking to give a gift to the insurance industry in return for support on a National Health Care plan. A provision that would limit an individuals right to sue for injury or death as a result of negligence. This is pandering and letting insurance companies continue to run the show.

Scientists have said that we need to reduce carbon dioxide by 40% over the next ten years to keep our planet going, the Obama bill call's for 4%. What happened to taking on the energy companies?

Just as home sales begin to jump, well so do interest rates. Unemployment in the state of Florida is projected to hit 11% according to economists higher then the 9.1%national average.

The Iraq With drawl Plan offered by President Obama takes three month's longer then he promised and leaves between 35,000 and 50,000 troops behind.

The administration's refusal to prosecute member's of the Bush administration for their crimes is unfortunate and disappointing. It's shows that accountability is not important in government and set's a dangerous precedent which could allow future administrations to freely abuse power.

This is not what I voted for in November. I realize that the President walked into a huge mess but bowing down to insurance companies and selling out consumer's is not the way to achieve health care reform. Funding automakers who lay off American workers and send their plants to foreign countries is not the way to get the economy moving. Giving money freely to Wall Street and taking five months to release a regulation plan for financial markets (the administration will release a plan this week) is not demanding accountability.

A lot of liberal Democrat's backed Obama in the Democratic primary, I bet a lot of them are thinking they should of went with the trial lawyer from North Carolina.

John Edwards would never agree to a National Health Care plan that would take away an individuals right to sue for wrongful death or injury. John Edwards would have withdrawn troops and stopped the occupation in Iraq. Edwards spent his entire life fighting for people, he would of continued that tradition as President.

Give Obama the benefit of the doubt. He walked into a huge mess, its only been five months but at the same time expect more and in 2012 hold Obama accountable. If Obama continues to pander to insurance companies and energy companies, then I'll be the first one with a "Kucinich 2012" bumper sticker on my car.

Obama ran on a platform of hope, now we need a little audacity.

Bill Thompson for Mayor

Michael Bloomberg has been a good Mayor for New York City. A social liberal and fiscal moderate he has led the city through tough times but the Omar Edwards shooting shows that the City of New York needs new leadership. Michael Bloomberg has handled the shooting incident well but nearly after ten years of the shooting death of Amadou Diallo, one has to ask what has changed in New York City?

Edwards an African American cop was chasing a man who had broken into his car when he was gunned down by a white police officer. Ten years after the Diallo shooting and NYC Police Commissioner Ray Kelly is still talking about ways to improve training. Whats changed?

Bloomberg isn't a bad Mayor but Thompson would offer New York City a new direction and new leadership. Two unions representing 18,000 workers have endorsed Thompson for Mayor. Thompson would offer new leadership for the City.

Tasini for US Senate

I am changing my preference for the NY US Senate seat from Carolyn Maloney to Jonathon Tasini. I am strongly supporting Tasini for the Democratic nomination for the Senate and I truly believe he would provide New York with a progressive voice in the Senate. Tasini is a progressive Democrat in the mold of Paul Wellstone. A labor activist who is currently executive director of the Labor Research Association, Tasnini supports a single payer health care system "Medicare for All" which would allow companies and individuals to buy into the medicare system.

Tasini pledges, "I will vote against any funding to support the continuation of foreign occupations". "I will oppose any new wars of aggression". He pledges not to take money from weapon makers or defense contractors. He opposes the death penalty. He is a progressive and would be a great Senator for New York.

Obama, Medical Malpractice and National Health Care

If President Obama has his way a provision limiting the public's right to sue for injuries or death as a result of medical negligence will be tacked on to any National Health Care Bill. This is a gift to the insurance industry for their "cooperation". It must be stopped. Obama is selling out the very people who supported him. The fact is that INSURANCE INDUSTRY’S INVESTMENT PRACTICES ,NOT THE LEGAL SYSTEM CAUSE HIGH MALPRACTICE INSURANCE COSTS. If Obama insists on this there will not be a National Health Care Bill. It is one thing to compromise it is quite another to sell out. Call your representatives and let them know you oppose any bill that restricts one from suing for Medical Negligence. Tiller's abortion clinic to close

The abortion clinic in Kansas where Dr. George Tiller performed late term abortions will shut down permanently according to the DR's family. The Women's Health Care Services Clinic in Wichita Kansas was one of the few clinic's performing late term abortions.

The closure of the clinic is a major setback for women. The clinic in Wichita was one of only three clinics nationwide where women facing danger to their lives or carrying a fetus with horrible deformation could go to have an abortion after the 20th week. Scott Roeder who killed Tiller called the closing of the clinic "a victory for all the unborn children". The President of an anti abortion group called Operation Rescue said "they are thankful that Tiller's clinic will not reopen and thankful that Wichita is now abortion free." The right wing bastard went on to say, "We have worked very hard for this day, but we wish it would have come through peaceful, legal channels we were pursuing."

Blocking women from entering a clinic, tormenting women who are terminating their pregnancies to save their lives is peaceful? The Department of Justice must enforce the FACE Act against Roeder and begin to enforce the FACE Act against any protester who block an entrance to clinics. The FACE Act makes it a federal crime to use force, the threat of force, or physical obstruction to prevent individuals from obtaining or providing reproductive health care services.

I have no doubt that the FACE Act should be enforced in this case.

The extremists here at home

In the past two weeks we have seen two right wing extremist murders--the murder of abortion provider George Tiller and today sadly the shooting death of a security guard at the Holocaust Museum in Washington and yes I will say it these two violent attacks lay on the shoulder of the Republican Party!!

Republicans held their annual fund raising Senate-House dinner in Washington this past week where former House Speaker Newt Gingrich a front runner for the GOP Presidential nomination in 2012 urged the GOP faithful to defend religion's role in American society against attacks from liberal judges, academics, and media. Gingrich even went as far to say to the effect that the President has already failed. Limbaugh said months back that he had hoped Obama would fail.

Fox News the most conservative network in cable attacked Tiller, Fox News Commentator Bill O'Reilly referred to Tiller as "Tiller the Baby Killer" and compared him to Nazi's. He described Tiller as "executing babies" and "operating a death mill".


The right wing held tea parties through the country and white supremacists took these tea parties as a sign that their movement was gaining ground. Many of them urged racist members to attend these parties to protest America's first black President and the government. Then they act surprised when the far right lunatics start killing their way to a world where there are no blacks, no Jews, no liberals, no taxes.

In April, the Department of Homeland Security warned us of right wing extremism. The report released by DHS warned of anti Semitic behavior. Michael Steele, Rush Limbaugh and right wing leaders in Congress called on DHS Secretary Janet Napolitano to resign. Tonight I call on them to resign. The blood of TIller, the blood of the security guard at the Holocaust Museum lies squarely on the hands of the right wing. There hatred and fear mongering has gone too far, way too far. It is time for America to reject this right wing hatred.

It is time for Limbaugh, Sean Hannity, Bill O'Reilly and Republican leadership in Congress to recognize that there are right wing extremists in this country whose racism and hatred and anti Semitic behavior can create a serious problem for the security of American's who wish to live their lives in freedom and peace.

Hannity, O'Reilly, and Limbaugh must realize that their words are powerful. Republicans preach responsibility, it's time they practice it. These two brutal deaths lie at the steps of Republican headquarters in Washington and in America's heartland where they have been reving up anti government hatred, racism against women and the President, and urging violence against doctors who respect a woman's right to choose.
